Terms & Conditions
These Terms and Conditions set out how the KHC Growth System is provided, how we operate, and the responsibilities of both parties. They apply to all engagements and ensure a clear, structured, and commercially aligned working relationship.
KHC Group - Growth System

1. Legal Entity
1.1 These Terms apply to all products and services provided by Kalam Hussain trading as KHC Group (“we”, “us”, “our”).
1.2 KHC Group operates as a sole trader. All contracts are formed with Kalam Hussain personally.
2. Acceptance & Contract Formation
2.1 A binding agreement is formed when you:
Submit any enquiry or onboarding form
Make payment
Accept a proposal or invoice
Instruct us to begin work
Continue engagement after being directed to these Terms
2.2 You confirm you have read and accepted these Terms.
3. Nature of the Growth System
3.1 The KHC Growth System is a subscription-based, managed infrastructure designed to improve enquiry handling and business conversion.
3.2 It is not a standalone service, and is not sold as individual deliverables.
3.3 Any websites, funnels, automation, messaging systems, or creative outputs are components of the system.
4. Scope & Discretion
4.1 The system is built and managed at our sole discretion.
4.2 We determine:
Structure and architecture
Number of pages or funnels
Automation logic
Creative output
Tools and integrations
4.3 Requests outside the intended system design are not included.
5. Fees & Billing
5.1 The Growth System is billed at:
£997 per month
£0 setup fee (where applicable)
5.2 Minimum commitment: 3 months
5.3 Payments are made monthly in advance.
5.4 Agreements renew in rolling 3-month cycles
5.5 All payments are non-refundable.
6. Cancellation & Termination
6.1 Cancellation requires 30 days written notice prior to the next billing cycle.
6.2 Failure to provide notice results in automatic renewal.
6.3 Early termination does not remove payment obligations.
7. Ownership & Licensing
7.1 All systems, frameworks, workflows, assets, and infrastructure remain the exclusive property of KHC Group.
7.2 You are granted a limited, revocable licence to use the system during active subscription.
7.3 Upon cancellation or non-payment:
Access is revoked
Systems may be disabled or removed
No data, systems, or assets are transferable
7.4 You may not copy, replicate, reverse-engineer, or reproduce any part of the system.
8. Digital Assets (Websites, Funnels, etc.)
8.1 Any websites or funnels are part of the system and not standalone deliverables.
8.2 These remain our property at all times.
8.3 No ownership or transfer rights are granted.
9. Advertising (If Included)
9.1 Ad management and creatives may be included.
9.2 Ad spend is paid directly by the client.
9.3 Minimum recommended spend: from £14/day.
9.4 No performance guarantees are provided.
10. No Performance Guarantee
10.1 We do not guarantee:
Leads
Sales
Revenue
Conversion rates
10.2 Results depend on external factors beyond our control.
11. Client Responsibilities
11.1 You must:
Provide access, logins, and permissions
Respond promptly when required
Provide accurate information
11.2 Delays caused by the client are not our responsibility.
12. Usage Limits & Fair Use
12.1 The system includes messaging, automation, AI, and communication tools.
12.2 These operate under a fair use policy.
12.3 Excessive usage may result in:
Restrictions
Additional charges
Plan changes
13. Third-Party Systems
13.1 The system relies on external platforms and infrastructure.
13.2 We are not liable for:
Platform outages
Account suspensions
Policy changes
14. Data & Privacy
14.1 We process data in accordance with UK GDPR.
14.2 You are responsible for your own compliance.
15. Limitation of Liability
15.1 Liability is limited to fees paid in the previous 30 days.
15.2 We are not liable for:
Loss of revenue
Loss of opportunity
Indirect damages
16. Suspension of Service
16.1 We may suspend access if:
Payment fails
Terms are breached
System misuse occurs
17. Intellectual Property Protection
17.1 All methods, systems, and strategies are proprietary.
17.2 Any attempt to replicate or extract system logic is prohibited.
18. Conduct & Abuse
18.1 We reserve the right to terminate service for:
Abuse
Harassment
Misuse of systems
19. Independent Services
19.1 Individual services may be provided at our discretion.
19.2 These are billed from £60/hour.
20. Force Majeure
20.1 We are not liable for events outside our control.
21. Governing Law
21.1 Governed by the laws of England and Wales.
22. Entire Agreement
22.1 These Terms form the full agreement.
