Terms & Conditions

These Terms & Conditions govern all services provided by Kalam Hussain, (trading as KHC Group, including services offered under the trading names KH Creative and KH Connect). By engaging our services, making payment, or continuing to use our services, you agree to be bound by these Terms.

1. Definitions & Legal Entity

1.1 These Terms and Conditions (“Terms”) apply to all services provided by Kalam Hussain, trading as KHC Group, including services offered under the trading names KH Creative and KH Connect (“we”, “us”, “our”).

1.2 KHC Group is not a limited company. Kalam Hussain operates as a sole trader. KH Creative and KH Connect are branding and trading names only and are not separate legal entities.

1.3 The client (“you”, “your”) agrees that all contracts, payments, invoices, liabilities, and legal matters are entered into with Kalam Hussain t/a KHC Group.


2. Acceptance of Terms

2.1 By engaging our services, submitting payment, signing an agreement, or proceeding with work, you confirm acceptance of these Terms.

2.2 If you do not agree to any part of these Terms, you must not use our services.

2.3 Any variation to these Terms must be agreed in writing.


3. Services Overview

3.1 KHC Group provides, but is not limited to:

  • Content creation and production

  • Videography, video editing, and graphic design

  • Meta advertising and campaign management

  • Creative Plan subscriptions

  • Connect Plan subscriptions

  • One-off production services

3.2 The exact scope of services is defined by the selected plan, quotation, invoice, or written agreement.


4. Creative Plan Subscriptions (KH Creative)

4.1 Creative Plans provide access benefits only and do not include production or content creation unless explicitly agreed.

4.2 Benefits may include:

  • Priority booking

  • Faster turnaround

  • Priority WhatsApp support

  • 40% discount on applicable production rates

4.3 Descriptive language such as “you shoot, we edit” does not mean editing is included in the subscription.

4.4 A minimum 3-month commitment applies to all Creative Plan subscriptions.

4.5 Subscriptions are billed monthly. Annual arrangements may be agreed in writing.

4.6 Subscription fees are non-refundable.


5. One-Off Production & Hourly Services

5.1 One-off services are available with or without a Creative Plan.

5.2 Base rates (without a Creative Plan) are from £50/hour.

5.3 Discounted rates (with a Creative Plan) are from £30/hour.

5.4 Second videographer rates are from £75/hour.

5.5 Additional videographers are charged:

  • £15/hour with a Creative Plan

  • £25/hour without a Creative Plan

5.6 All rates are “from” prices and may vary depending on scope and complexity.

5.7 Work is billed hourly unless a fixed price is agreed in writing.


6. Deposits

6.1 Deposits are required where:

  • A fixed price is agreed, or

  • Travel or booking security is required

6.2 Deposits are non-refundable.


7. KH Connect – Advertising Services

7.1 KH Connect provides Meta advertising management services only.

7.2 A minimum 3-month contract applies to all Connect Plans.

7.3 Ads are run on the client’s own ad account. Ad spend is paid directly to Meta.

7.4 We do not guarantee results, leads, conversions, or performance.

7.5 Any performance figures shown are targets or estimates only and not guaranteed.

7.6 Performance depends on factors outside our control, including market conditions, ad spend, creative quality, platform changes, and client decisions.


8. Ad Creative & Creative Requirements

8.1 Ad creatives are not included in Connect Plans.

8.2 Creatives must be:

  • Purchased via KH Creative, or

  • Discounted through the Ad Creative Plan (£200/month)

8.3 Client-supplied creatives may be rejected if deemed unsuitable.

8.4 Poor performance resulting from client-supplied creatives is not our responsibility.


9. Intellectual Property

Creative Services

9.1 We retain ownership of all:

  • Raw footage

  • Project files

  • Working files

9.2 Clients receive rights only to the final exported deliverables paid for.

Advertising Services

9.3 We retain ownership of:

  • Campaign structures

  • Ad sets

  • Ads

  • Copy

  • Strategy

  • Funnels

  • Data insights

9.4 Clients may not copy, replicate, reverse-engineer, or train internal teams using our work.


10. Website Development, Funnels & Digital Assets

10.1 KHC Group may provide website-related services including, but not limited to:

  • Website design and development

  • Shopify and other e-commerce platform builds

  • Landing pages and sales pages

  • Funnel building and optimisation

  • Conversion-focused layouts and structures

  • CRM, analytics, tracking pixel, and third-party integrations

10.2 Website and funnel services are bespoke and quoted on a case-by-case basis. No website, funnel, or development work is included in any subscription unless explicitly agreed in writing.

10.3 Clients are responsible for:

  • Accuracy of all content, products, pricing, and legal information

  • Compliance with applicable laws and regulations

  • Hosting accounts, domains, platform subscriptions, and third-party tools unless agreed otherwise

10.4 KHC Group is not responsible for issues arising from third-party platforms including, but not limited to, Shopify, hosting providers, plugins, themes, payment gateways, or platform updates.

10.5 Website and funnel services are provided on a best-practice basis only. We do not guarantee sales, conversion rates, revenue, or business performance.

10.6 Revisions are limited to what is agreed. Out-of-scope changes are chargeable. Once approved or launched, work is deemed accepted.

10.7 Unless agreed in writing, ongoing maintenance, updates, backups, hosting, and monitoring are not included.

10.8 All underlying frameworks, methodologies, layouts, and systems remain the intellectual property of KHC Group unless otherwise agreed.


11. Payments & Billing

11.1 Payments are processed via Stripe or other agreed methods.

11.2 Cash payments are accepted only for one-off services, must be agreed in advance, and are not permitted for subscriptions.

11.3 Klarna is permitted only for one-off invoices and subject to approval.

11.4 Klarna is not available for subscriptions.

11.5 If Klarna fails, payment is due immediately via another method.


12. Late Payments & Suspension

12.1 Subscription benefits are suspended immediately upon non-payment.

12.2 Services terminate after 7 days unpaid.

12.3 Outstanding balances remain payable and may be recovered.

12.4 We may set up recurring payments or direct debit authorisations.


13. Travel, Expenses & Charges

13.1 All travel-related costs are payable by the client.

13.2 Mileage is charged at £0.45 per mile minimum, increasing in densely populated areas.

13.3 Clients are responsible for:

  • Parking fees and fines

  • Congestion charges

  • ULEZ / LEZ / Clean Air Zones

13.4 Public transport, taxis, and ride-hailing costs are payable by the client.

13.5 International work requires clients to cover flights, accommodation, visas, insurance, passport renewals, and subsistence.

13.6 Travel costs must be paid in advance or reimbursed upon invoicing.


14. Client Responsibilities

14.1 Clients must provide timely feedback, assets, access, and approvals.

14.2 Delays caused by the client automatically extend timelines.

14.3 Approved work is deemed accepted and final.


15. Revisions

15.1 Revisions are limited to what is agreed.

15.2 Excessive or out-of-scope revisions are chargeable.


16. Compliance & Advertising Responsibility

16.1 Clients are responsible for legal compliance of their business, claims, and landing pages.

16.2 We are not liable for ad rejections or account restrictions caused by client activity.


17. Contractors & Team Members

17.1 We may use subcontractors and freelancers.

17.2 Contractors are not employees and cannot bind contracts.

17.3 We are responsible only for final deliverables.


18. Non-Disparagement & Non-Solicitation

18.1 Clients agree not to make false or harmful statements about us.

18.2 Clients may not solicit or hire our contractors.


19. Force Majeure

19.1 We are not liable for delays caused by events beyond our control, including illness or emergencies.


20. Limitation of Liability

20.1 Our total liability is capped to fees paid in the last 30 days.

20.2 We are not liable for indirect, consequential, or financial losses.


21. Governing Law

21.1 These Terms are governed by the laws of England and Wales.


22. Entire Agreement

22.1 These Terms constitute the entire agreement between the parties.
